Moody's downgrades Vietnam credit rating

HANOI, Vietnam (AP) ? Moody's Investors Service has downgraded Vietnam's credit rating, citing weaknesses in its banks and a stuttering economy.

The downgrade to B2 from B1 for government bonds issued in local or foreign currency announced Friday means the country would face higher borrowing costs if it sells new bonds.

It could also deter foreign investment, adding to problems in an economy once seen as an emerging Asian powerhouse.

The problems in the banking system stem from a credit boom in 2009 and 2010. Much of the money lent is now considered bad debt and a lack of transparency within the banks is adding to investor jitters.

The banks are now unwilling to lend money, causing the economy to slow to 5 percent growth after a decade of 7 percent-plus growth.

Second Suicidal Florida Pilot Missing

About one week after a reportedly suicidal pilot and his plane disappeared from central Florida, a piece of wing has been found floating off Florida's north east coast that may be associated with a different reportedly suicidal pilot. Investigators are seeking to determine if the four-foot wing section belongs to a Cessna 172 piloted by Gene Milowicki, a retired Navy commander with 24 years service. Milowicki resigned on September 14, from his subsequent position as director of aviation programs at Florida State College, Jacksonville. Police found a suicide note in Milowicki's car, which was parked in his hangar at Herlong airport. The report comes roughly one week after Michael Sills and his Piper Archer, disappeared under similar circumstances from Orlando-Apopka Airport.

In both cases, investigators feel that there is sufficient evidence to support the theory that the men committed suicide. Before his disappearance on September 11, Sills reportedly threatened to crash his aircraft into the home of his ex-girlfriend, or another building. His car was also found at his home airport. There was blood inside the car and the exhaust had been rigged for what appeared to be a suicide attempt. A witness told investigators that his airplane departed the airport that night and the FAA had joined local authorities in searching for the aircraft. In the case of Milowicki, his pastor told police the veteran had told him he had considered flying into the ocean, according to Jacksonville.com. Both men had troubled relationships with women from whom they'd separated prior to their disappearance. Both involved legal complications related to their relationships. The wing section was recovered by a dive charter boat. "We went to flip it over and fuel started spilling out," one passenger said. The Coast Guard began searching for human remains, Tuesday and continued Wednesday.

NFL, refs?reach tentative deal

Replacements worked first three weeks of games, triggering wave of outrage from fans, teams

NEW YORK - The NFL's regular officiating crews are back. Their return couldn't have come soon enough for many players, coaches and fans.

After two days of marathon negotiations - and mounting frustration throughout the league - the NFL and the officials' union announced at midnight Thursday that a tentative eight-year agreement had been reached to end a lockout that began in June.

The deal came on the heels of Seattle's chaotic last-second win over Green Bay on Monday night in which the replacement officials struggled. Commissioner Roger Goodell, who was at the bargaining table Tuesday and Wednesday, said the regular officials would work the Browns-Ravens game at Baltimore on Thursday night.

"We are glad to be getting back on the field for this week's games," NFL Referees Association president Scott Green said.

And plenty of players echoed that sentiment.

"Welcome back REFS," Buffalo Bills running back C.J. Spiller tweeted shortly after the news broke.

The tentative deal must be ratified by 51 percent of the union's 121 members. They plan to vote Friday and Saturday in Dallas.

For the Packers, Redskins, Lions and other teams who voiced their displeasure with calls that might have swayed games, the agreement doesn't change their records. But after having replacements for the first three weeks, triggering a wave of outrage that threatened to disrupt the rest of the season, Titans quarterback Matt Hasselbeck probably spoke for his peers by simply echoing Spiller: "Welcome back."

The agreement hinged on working out pension and retirement benefits for the officials, who are part-time employees of the league. The tentative pact calls for their salaries to increase from an average of $149,000 a year in 2011 to $173,000 in 2013, rising to $205,000 by 2019.

Under the proposed deal, the current defined benefit pension plan will remain in place for current officials through the 2016 season or until the official earns 20 years' service. The defined benefit plan will then be frozen.

Retirement benefits will be provided for new hires, and for all officials beginning in 2017, through a defined contribution arrangement. The annual league contribution made on behalf of each game official will begin with an average of more than $18,000 per official and increase to more than $23,000 per official in 2019.

Beginning with the 2013 season, the NFL will have the option to hire a number of officials on a full-time basis to work year round, including on the field. The NFL also will be able to retain additional officials for training and development, and can assign those officials to work games. The number of additional officials will be determined by the league.

"As you know, this has to be ratified and we know very little about it, but we're excited to be back. And ready," referee Ed Hochuli told The Associated Press in a telephone interview. "And I think that's the most important message - that we're ready."

The longest contract with on-field officials in NFL history was reached with the assistance of two federal mediators.

Replacements have been used both to play and officiate NFL games before. In 1987, the players went on strike and three games were played with replacement players. In 2001, the first week of the regular season was officiated by replacements before a deal was worked out.

One big difference: The replacements 11 years ago generally came from the highest levels of college football. These officials were from lower college divisions or other leagues such as Arena Football.

After Seattle's 14-12 victory against the Packers, their ability to call fast-moving NFL games drew mounting criticism, with ESPN analyst Jon Gruden calling their work "tragic and comical."

The Seahawks beat Green Bay on a desperation pass into the end zone on the final play. Packers safety M.D. Jennings had both hands on the ball in the end zone, and when he fell to the ground in a scrum, both Jennings and Seahawks receiver Golden Tate had their arms on the ball.

The closest official to the play, at the back of the end zone, signaled for the clock to stop, while another official at the sideline ran in and then signaled touchdown.

The NFL said in a statement Tuesday that the touchdown pass should not have been overturned - but acknowledged Tate should have been called for offensive pass interference before the catch. The league also said there was no indisputable evidence to reverse the call made on the field.

That drew even louder howls of disbelief. Some coaches, including Miami's Joe Philbin and Cincinnati's Marvin Lewis, tried to restore some calm by instructing players not to speak publicly on the issue.

Fines against two coaches for incidents involving the replacements were handed out Wednesday.

Patriots coach Bill Belichick was docked $50,000 for trying to grab an official's arm Sunday to ask for an explanation of a call after his team lost at Baltimore. And Washington offensive coordinator Kyle Shanahan was tagged for $25,000 for what the league called "abuse of officials" in the Redskins' loss to Cincinnati on Sunday. Two other coaches, Denver's John Fox and assistant Jack Del Rio, were fined Monday for incidents involving the replacements the previous week.

"I accept the discipline and I apologize for the incident," Belichick said.

Players were in no mood for apologies from anyone.

"I'll probably get in trouble for this, but you have to have competent people," Carolina receiver Steve Smith said. "And if you're incompetent, get them out of there."

And now they are out.

Avalanna Routh, 'Mrs. Bieber,' Dies From Brain Cancer

We?re beyond bummed to report this news. Avalanna Routh, the adorable, six-year-old Justin Bieber fan known as ?Mrs. Bieber,? who touched our hearts when footage of her Valentine?s Day date with The Biebs made national news, has died.

The little angel was from the Boston area and suffered from a rare and aggressive form of brain cancer. The condition is so rare, in fact, that only 30 cases per year are diagnosed in the U.S. and it is highly fatal.

Routh died Wednesday, Sept. 26, news which was tweeted by her heartbroken family.

Mrs. Bieber came to national attention since she was able to meet The Biebs and spend Valentine?s Day with him thanks to a pretend wedding that hospital workers staged for her during treatment. A social media campaign went viral and caught The Biebs attention. He arranged to meet her in New York, and nothing, not even cancer, could wipe the smile off the beautiful little girl?s face as she spent the day with her hubby!

The Associated Press reports that the Dana-Farber Cancer Institute praised Routh for raising awareness about the disease and need for more research.

The Biebs tweeted about Avalanna?s death, and asked fans to pray for her.

R.I.P., Avalanna! Heaven is a more beautiful place now that you?re there.

Lawyer Diaries: SEC Chairman Interview

The following Lawyer Diary comes in the form of an interview with David S. Ruder. He's a former Chairman of the Securities and Exchange Commission. This interview is excerpted from Learning From Precedent.

Bloch: In terms of your future career, what was the biggest value of going to law school?

Ruder: After practicing law, I came to Northwestern Law School as a professor, then dean. Eventually I became Chairman of the Securities and Exchange Commission. I would say that the biggest value of law school for all of those positions was the ability to see both sides of issues.

In law school you?re taught that the law is not one-sided. The better lawyers not only understand the points on their side of the argument, but the points that the other side makes as well. Understanding opposing views allows you to be prepared to meet and rebut arguments.

I think that the ability to see both sides of a problem is also very beneficial to the businessperson. I?ve always thought that law is great training for business. If you can see both sides, you can anticipate problems that will arise when you follow your own inclinations.

That?s not to say that there aren?t downsides from training to be a lawyer. For example, some lawyers tend to become risk-averse because they see problems everywhere. To me, the ideal businessperson is someone who is willing to take risks, but can also recognize obstacles that are bound to arise.

Bloch: I?ve heard from many lawyers who say it?s important to learn business, and from many businesspeople who say it?s important to learn law. It seems as though the skill sets of the two professions are complementary.

Ruder: At a major law school like Northwestern, many of our graduates tend to go into the world of business, corporations, and commercial transactions. There are other areas of law such as estate planning, torts, criminal law, and property law that may not seem to involve business. I often find students who say, ?I?m not interested in business law so I?m not taking any business courses.? And I say to them, ?Do you think your clients are never going to have any business interests? Shouldn?t you be able to understand the business interests of that client? Shouldn?t you be able to understand what obstacles those clients may have in becoming financially successful?? Sometimes I hear students say, ?I don?t want to be in business law. I want to go to trial.? And I say, ?What kind of cases will you be trying? Do you never plan on having a business case that you?ll try??

I think that avoiding business matters is wrong. The need to learn something about business is crucial for almost all types of law practice.

Bloch: Are there other sets of knowledge law school provides?

Ruder: I think that many people who have not gone to law school not only don?t understand the nature of the legal process, but also don?t know how historically the law became an alternative to war. In its simplest form, legal practice involves conflict resolution. In conflicts, each side has a different view. In the pre-law days, armies were sent out to decide conflicts. Eventually, lawyers became the combatants. In our legal system, the brightest legal minds, the best arguers, and the best thinkers come together to try to resolve conflicts.

Bloch: How did all of these understandings contribute to your career as a law school dean and as Chairman of the SEC?

Ruder: In some ways, I was fortunate to have been the dean of a law school before I became SEC Chairman. A dean has to deal with various constituencies?students, staff, professors, alumni, university administration, other departments, and other schools. I had a fair amount of experience dealing with these constituencies, and I was sensitive to the fact that each of them required attention.

As Chairman, similar responsibilities existed. I had to deal with investors, staff, other commissioners, Wall Street, Congress, the administration, and the press. In Washington, I quickly learned that no matter how much I thought I knew about something, I always had more to learn. I had some understanding of how Wall Street worked, but not a deep understanding of how individual large firms operated. I had a very steep learning curve, particularly when the stock market crashed only a few months after I arrived.

Bloch: Can you tell me about your time as Chairman? What motivated your move from academia?

Ruder: On the motivation side, as a professor I was interested in corporate and securities law. After 25 years or so as a law professor, I had become intensely involved in learning about securities regulation and securities markets. I had an abiding interest in the regulation of the purchase and sale of securities, in fraudulent conduct in the securities world, and in the operation of the securities markets. From my point of view?from a securities professor?s point of view?when I was offered the opportunity to lead the organization I had been studying all my life, the answer was, ?Yes!?

In terms of how I got there, the track was quite different than most people who become Chairman of the Securities and Exchange Commission. Most chairmen have some political connections and are active in a political party. I had no political background. I had begun by writing articles in the securities field. As a result of those articles, I was asked to speak. I spoke at a great number of securities meetings with lawyers. As a result of those speeches, I became active in the American Bar Association, and I served in its Business Law section. As a result of my various activities, I was asked to participate in a securities law project for the American Law Institute, the most learned of the legal organizations in the United States.

The then-Chairman of the SEC decided to retire after six years in the position. President Reagan looked for a suitable replacement from Wall Street and from regulators, but finally, decided to look at lawyers. Reagan?s people began to ask around the White House, where many of the top people were lawyers. They asked for suggestions for Chairman of the SEC. It turned out that my name came up on almost all of the lists!

I think I was selected because of a combination of my reputation in the securities field from writing, speaking, and participating in activities of the American Bar Association, and my work in the academic world as a dean. I don?t advertise this, but I knew that I wasn?t a political candidate, so I called myself the ?competency candidate? instead!

Report indicates growth for business VoIP in New Zealand | Packnet

Business VoIP (voice over internet protocol) has shown significant expansion in New Zealand and is likely to grow even further, a new report has strongly implied.

The report, issued by respected independent research organisation Frost & Sullivan, points to business VoIP and telephony in general being one of the main catalysts behind what it claims is a 6.6% growth in the unified communications (UC) market in New Zealand over the course of 2011.

The report predicts that voice telephony will continue to be a strong influencing factor in helping the market to grow well into 2018, at a compound annual growth rate (CAGR) of more than 9%.

The market, says the report, will be further boosted by the capacity of enterprises to benefit from online rather than premises-based solutions, thus helping to reduce set-up and ongoing maintenance costs.

In the case of business VoIP, this has of course been demonstrated globally via the increasing use of a host business VoIP provider or VoIP reseller to provide such services, where the cost of installing in-house internet protocol (IP) telephony equipment would otherwise prove too prohibitive.

The report adds that although videoconferencing, another popular IP telephony service, will also play a significant role in UC adoption, it is voice telephony which is likely to be seen by end users as the most important aspect of UC for their organisation.

UC, which essentially equates to the receipt of different communications signals via a single terminal point, has been strongly influenced by developments in IP telephony and business VoIP over the years, with voice calls, faxes and emails all conveniently accessed by the end user at a common IP telephony reception point.

The Frost & Sullivan report could be said to demonstrate further that UC, business VoIP and IP telephony will continue to be taken up on an increasingly global scale.

Anxiety, Sexual Issues Dog Prostate Cancer SurvivorsMen who have undergone surgery for prostate cancer often experience significant levels of anxiety one year after the surgery, according to new research that links increased anxiety to poor sexual satisfaction and depression.

In a study published online in Psycho-Oncology, researchers at the Mayo Clinic suggest these men would benefit from counseling to address their worries and improve their quality of life.

While prostate cancer can be a life-threatening disease, most men diagnosed with prostate cancer do not die from it, the researchers note.

According to the American Cancer Society, more than 2.5 million men in the United States who have been diagnosed with prostate cancer are still alive.

?The 10-year survival for a man undergoing surgery to remove localized prostate cancer is greater than 95 percent. Given that the majority of men who undergo prostatectomy for prostate cancer will not die from their disease, we are concerned about what life will be like for these patients decades after diagnosis and treatment,? said the study?s senior investigator, Alexander Parker, Ph.D., an associate professor of epidemiology and urology.

In the study, the researchers asked 365 men to complete a questionnaire one year after they underwent prostate cancer surgery. The questionnaire was designed to measure anxiety levels about the fact they have been diagnosed and treated for prostate cancer.

The men also completed additional questionnaires to measure levels of erectile function, sexual satisfaction and depression.

The results showed that those men who reported high anxiety levels are more likely to report low sexual satisfaction and a high rate of depression symptoms, according to the researchers.

?What is interesting from the sexual health standpoint is we observed that anxiety was not linked to poor erectile function per se but was linked to low levels of sexual satisfaction,? Parker said.

?If our results can be confirmed by other investigators, it would suggest that anxiety is not affecting some men?s ability to perform sexually but perhaps more their ability to enjoy their sex life.?

While the researchers observed that anxiety was generally higher in those men who had more aggressive forms of prostate cancer based on their pathology reports after surgery, a number of men with nonaggressive cancer also reported very high levels of anxiety, according to Parker.

?Among this specific subgroup of men with prostate cancer who have less aggressive disease we are talking about survival rates of nearly 100 percent, yet they think about cancer every day,? he noted. ?This presents a great opportunity for identifying these men and offering intervention aimed at modifying this anxious behavior.?

Mayo Clinic offers cancer patients access to behavior-based counseling led by trained psycho-oncologists. Parker noted the results of this new study underscore the opportunity to test new ways of addressing this need in men with prostate cancer.

?Anxiety about a cancer diagnosis can lead to increased depressive symptoms and an inability to enjoy life?s activities, including sexual relations,? he said. ?We are building on these results by designing trials to test whether counseling can help these patients.?

However, the ads' effectiveness apparently didn't have any bearing on actual tablet sales. Samsung has only sold 10 million Galaxy Notes worldwide whereas earlier this year Apple was estimated to sell over 50 million iPads in 2012.

Furthermore, the Galaxy Note is very different from an iPad when you consider that, well, it's also a phone. Ace Metrix told Business Insider that the Galaxy Note was included on the list because it's the only phone that's being marketed as both a smart phone and a tablet. The Galaxy Note is 5.3 inches and barely fits in a pocket, after all.

The Galaxy Note 10.1, released last month, is a 10-inch tablet that is an iPad competitor. The device made the Ace Metrix list, and people apparently liked its ads more than the iPad's.

And if we're looking at phone ads, the iPhone's most popular ads with Zooey Deschanel and Samuel L. Jackson scored 653 and 645, which is still lower than the top four tablet spots on this list.

The rankings also clear up a separate tablet rivalry. While two Kindle ads made the list, the Nook was conspicuously absent.

The rail company has licensed the use of the clock face in the past, including to the watchmaker Mondaine. It sells a wristwatch featuring the design and an ?official Swiss station clock? watch at its currency exchange counters and select stations.
